A federal lawsuit filed in September 2024 by Republican lawmakers and Attorney General Jason Miyares challenges Virginia's Democratic-drawn 2021 congressional map as an unconstitutional racial gerrymander, propelling the 77% implied probability of a new map for the 2026 midterms. A three-judge U.S. District Court panel expedited the case in October, setting a March 2025 trial amid deadlines for discovery and remedies, as the split legislature—Republican House, Democratic Senate—remains deadlocked on voluntary redistricting. The current map, upheld by the Virginia Supreme Court in 2023 and used in 2024 elections, faces claims of vote dilution; traders see court intervention as the key path to change before the midterm cycle.
