Growing state and local pushback against AI data centers' massive energy demands and grid impacts has driven the 91.5% Yes odds on a qualifying moratorium clearing before 2027. Recent enactments in counties across North Carolina, Arkansas, and Florida, plus New York's active push for a three-year statewide pause and Maine's bill targeting projects until late 2027, signal broad momentum despite some veto risks. Federal legislation from Sanders and AOC has spotlighted the issue without advancing far. Traders see the proliferation of over 100 local measures and ongoing state proposals as likely to produce a qualifying outcome by year-end, though narrow definitions, failed bills in key states, or quick reversals could still shift the trajectory.

A qualifying moratorium go into effect against the construction of any facility described in the legal text as an AI data center, AI compute facility, AI training/inference data center, or similar. Any moratorium that applies to all “data centers” will also qualify.
The signing of such a bill will qualify regardless of the date such a moratorium actually comes into effect, or whether an injunction is put into place against qualifying legislation.
The primary resolution source for this market will be official information from the US Government. However, a consensus of credible reporting will also be used.
