Trader consensus heavily favors "No" at 81.5% implied probability, reflecting stalled legislative momentum despite heightened scrutiny over AI data centers' massive energy demands and environmental impacts. The March 25 announcement of the federal Artificial Intelligence Data Center Moratorium Act by Sen. Bernie Sanders and Rep. Alexandria Ocasio-Cortez generated buzz but failed to advance amid industry lobbying, economic incentives like tax breaks in 38 states, and political gridlock. State-level bills in places like Vermont (S.205) and proposed moratoriums in Maine and Pennsylvania remain unpassed, with 14 proposals across 11 states faltering as of mid-March. Local pauses in Georgia counties predate 2026 without broader AI-specific enactment. With eight months until 2027, upcoming sessions offer slim catalysts for surprise passage.

A qualifying moratorium go into effect against the construction of any facility described in the legal text as an AI data center, AI compute facility, AI training/inference data center, or similar. Any moratorium that applies to all “data centers” will also qualify.
The signing of such a bill will qualify regardless of the date such a moratorium actually comes into effect, or whether an injunction is put into place against qualifying legislation.
The primary resolution source for this market will be official information from the US Government. However, a consensus of credible reporting will also be used.
